Country Background

South Africa situated at the southern most tip of Africa has an estimated population of 47 million. Since 1994, it has had a democratically elected government.

The South African Police Service (SAPS) is responsible for internal security and crime prevention. The Minister of Safety and Security is responsible for
policing in general and is accountable to Cabinet and Parliament.

Crime Information and Statistics 2003 National Victims of Crime Survey South Africa
Description: In 2003, the Institute for Security Studies undertook the second national victims of crime survey in South Africa. The survey was designed to ensure comparability with the 1998 national Victims of Crime survey conducted by Statistics South Africa for the Department of Safety and Security and the United Nations Interregional Crime and Justice Research Institute (UNICRI). The ISS was assisted throughout the study by a group of stakeholders from government and civil society, many of whom participated in the 1998 survey.

Crime Information and Statistics 1998 Victims of Crime Survey (1998)
Description: This statistical release presents the results of a 1998 survey that was conducted to investigate the impact of crime in the South African community. This report examines crime from the point of view of the victim. It examines the extent of reporting of crime, explores the perceptions that different people have about the police and police services, and act as a benchmark against which future surveys of the same nature can be compared.

Legislation 1998 Domestic Violence Act, 116 of 1998
Description: This Act obliges SAPS officials to perform certain duties with regards to domestic violence including asssisting victims and explaining their rights.

Description: The Independant Complaints Directoratie (ICD) is a government department that was established to investigate complaints of brutality, criminality and misconduct against members of the South African Police Service (SAPS), and the Municipal Police Service (MPS). This piece of legislation (Chapter 10 of the SAPS Act) governs the conduct of the ICD, outlining its function, structure and roles.

Legislation 1996 The Constitution of the Republic of South Africa, Act 108 of 1996.
Description: The role of the police is specified in section 205 of the Constitution. Chapter 9 makes provision for the establishment of a number of state institutions, for example, the Public Protector, Human Rights Commission and the Auditor–General. These institutions have investigative and monitoring powers in terms of other state departments, including SAPS.

Legislation 1995 South African Police Services Act 68 of 1995
Description: This act provides for the establishment, organisation, regulation and control of the SAPS. This act was after the previous police forces were amalgamted to form the new SAPS after 1994. It controls and govrens the behaviour, structure and function of the SAPS.
